Here we report all the terms, conditions, and policies of Lexington Power Yoga, LLC, and Sweat and Soul, INC, DBA LPY Yoga and LPYOnDemand (hereafter referred to as “us” or “we”), related to the classes and events provided by LPY Yoga, in person at the studios, through our streaming service, or on demand, and to the use of our Websites (lpyyoga.com and lpyondemand.com) and our branded apps (hereafter all referred to as “Service”).
Changes & Updates
We may update our conditions, terms, and policies from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons. Your continued use of our Service constitutes your agreement to any potential update/change on a prospective basis.

Privacy Policy
This Privacy Policy describes how your personal information is collected, used, and shared when you use our streaming service, LPY On Demand through our website lpyondemand.com, or any of our branded apps used to register for classes and events (together, the “Service”).
By using the Service, you agree to the collection, use and disclosure of your information as described in this Privacy Policy. We may modify this Privacy Policy from time to time. Your continued use of the Service constitutes your agreement to any updated Privacy Policy on a prospective basis.
INFORMATION WE COLLECT
When you use the Service, we collect the following types of information:
Account Registration Information. In order to sign up for a free trial or make a purchase, you must create an account by providing us with your email address and a password. You may also create a username and upload an avatar to use for comments or forums.
Payment Information. You must also provide valid payment card information if you wish to sign up for a free trial, subscription, or make any other purchase. Except for the name associated with your card and information about the transaction (e.g., time of transaction, amount), payment card information is collected directly by a third-party payment vendor and is not received or stored by us.
Information Collected Automatically. Each time you visit the Service, we automatically collect certain information about your device and your interaction with the Service. This may include your viewing activity, your IP address, location information, your browser type, your Internet service provider (ISP), referring/exit pages, your operating system, date/time stamps, and related metadata.
Comments. We may offer the ability to provide comments or to post messages in a forum. Any posts you make will be publicly available.
Other . You may also choose to provide other information about yourself in connection with surveys, special offers, customer support inquiries, and other communications with us.
HOW WE USE YOUR INFORMATION
We may use the information collected about you to:
Fulfill your orders and deliver content to you
Send you marketing communications (depending on your preferences)
Provide customer support to you
Analyze how the Service is being used for troubleshooting and improvements
Communicate with you
Collect debts, prevent fraud, and protect the integrity of the Service

Service Providers. We share your information with authorized service providers involved in operating the Service. Our authorized service providers include customer service providers, payment providers, and email service providers.
Legal Situations. We may disclose your information when we have a good faith belief that compliance is required by a search warrant, subpoena, court order, or similar request from a law enforcement or other government agency.
Public. We may publicly disclose aggregated user statistics and other information, which is not considered personal information. If you comment on a video or participate in a forum, your comment will be available to the public.
YOUR PRIVACY RIGHTS
You may change your account information or close your account at any time through your account settings, by logging into your account. If you close your account or request that we delete your account, you may lose access to content you have purchased.
When you close your account, we may preserve your account information to
let you know about new offers and content;
restore your account, if you ever wish to re-subscribe; and
where we believe in good faith that preservation is necessary to enforce our rights.
CHILDREN’S PRIVACY
The Service is not intended for individuals under the age of 16. If you are a parent or legal guardian who has discovered that your child has provided personal information through the Service without your consent, please contact us so that we can remove any unauthorized information.
EMAILS & COMMUNICATIONS
When you create an account, you may receive certain emails:
Transaction Emails. When you first create an account, we may send you a welcome email that provides information about your subscription and your account. If you make a purchase, we may send you an email confirming your purchase. We may also send you other emails concerning your account status and renewals. You may not opt out of transactional emails.
Marketing Emails. Depending on your preferences, we may send you emails letting you know about new programs or features, or promotions.
OPT-OUT Option. You may opt out of these emails at any time from your account settings.
EEA USERS
Users from the European Economic Area (EEA) have the right to: opt out of cookies (see our Cookie Policy); access, correct, delete, restrict or object to our use of your personal information. If you would like to exercise any of these rights, please submit your request by emailing us.
We process personal information to fulfill contracts with you and to provide services you have requested (for example, to fulfill a purchase), or otherwise to pursue our legitimate business interests. Note that your information will be transferred outside of Europe, including to the United States.
CALIFORNIA USERS
Users from California have the right to: request information about the categories and sources of personal information collected about you, and the associated purposes for collection and third-party disclosures; request a copy of your personal information; request deletion of your personal information; and opt out of the sale of your personal information.
To exercise your right to access or delete your personal information, submit your request by emailing us. Note that to process your request, we must be able to verify your identity as the owner of the account you are inquiring about. We may not be able to fulfill your request until we can do so. Although you do not need to have an account to submit a request, we may not be able to locate certain information to process your request if you don’t have one.
NEVADA USERS
Nevada residents have the right to opt out of the sale of certain "covered information" collected by operators of websites or online services. We currently do not sell covered information, as "sale" is defined by such law, and we don't have plans to sell this information.
Class Attendance Policy
REGISTRATION
In order to allow our staff to make the class check-in process and set-up as smooth as possible, we highly recommend our customers to register beforehand to classes, through our website or our mobile app. Drop-ins to the studio without pre-registration are always welcome though.
CANCELLATION/NO SHOW POLICY
Cancel the class you reserved at least 2 hours before the starting time of the class, through our website or the mobile app, to avoid penalty and to free the spot for others.
“Every Mat Counts”: if you need to cancel your in-studio reservation, we kindly ask you to do so at least 2 hours in advance of the class starting time even if you do not pay any penalty. This way your spot will be available for others to sign up, and waitlisted people may join the class.
PLEASE NOTE: We can not accept cancellation requests via phone or email. Please access your LPY account through LPY website or the mobile app
If you cancel your class less than 2 hours in advance, or you do not show in class, you may incur in a late cancellation/no show fee:
Pass holders and drop-in purchases will have the visit deducted from their account, as if they attended;
Monthly Unlimited Members will be charged $15;
Annual & Auto Renew Members will be charged $15. They are granted 1 grace pass per month. Email us within 2 hours of the missed class to be graced.
WAITLISTS
Each and every class has a waitlist in case the class gets filled in. Don't loose your hope if the class you wanted to take is full. Simply register to have your name on the waitlist. If you move up from the waiting list, you will be notified up to 1 hour before the class so you may join. With our “Every Mat Counts” policy in place, the waitlists work efficiently. You can cancel yourself off the waitlist at any time without penalty. If you are notified you have been moved into the class, you’re not anymore in the waiting list, and if it happens within 2 hours of the class starting time, the late cancel/no show penalty will apply if you don't show up or do not cancel 2 hours in advance.
Risks & Liability
HEALTH RISKS
The use of the LPY facilities, as well as the practice of yoga, barre, pilates, TRX, Shine, as in other forms of exercise, naturally involves certain inherent risks of injury to you or your guest(s), whether you or someone elses cause it. As such, by using LPY facilities and accessing LPY services, you understand and voluntarily accept this risk.
LOSS OR THEFT OF MEMBERS’ PROPERTY
LPY is not responsible for personal items lost or stolen. The available storage spaces are offered without any protection. We have a LOST&FOUND area in each studio where all the items found during the day are stored, for a period of 30 days. Please ask the personnel if you need to check the LOST&FOUND out.
INFORMED CONSENT
In order to be able to access our Service, it is required that you read these Terms and Conditons, and sign the Waiver of Liability, reported below for your convenience. When you create a new account, your registration could be completed only if you confirm to accept the Wayver and LPY Terms and Conditions. By accepting to proceed with the registration, you explicitly agree with LPY Terms and Conditions, and in particular that LPY Yoga will not be liable for any injury, including, without limitation, personal, bodily or mental injury, economic loss or any damage to you, your spouse or partner, guest, unborn child, child, or relatives resulting from the negligence of LPY Yoga, anyone on the LPY Yoga’s behalf or anyone using LPY Yoga’s facilities.
WAIVER OF LIABILITY
I Understand and acknowledge that in yoga, as in other forms of exercise, there exist certain inherent risks. I voluntarily participate in the instruction taught at Sweat and Soul Yoga, inc, or Lexington Power Yoga, LLC, both operating as LPY Yoga, yoga classes and barre classes, and agree to assume full responsibility for all risks, injuries, or damages known or unknown, which might incur as a result of participating in the yoga program offered.
I understand that it is my responsibility to consult with my health care practitioner prior to and regarding my participation in yoga classes, barre classes, workshops, or other programs offered at Sweat and Soul Yoga, Inc, or Lexington Power Yoga, LLC doing business as LPY Yoga.. By signing below, I release Sweat and Soul Yoga and Lexington Power Yoga, it’s owners and instructors, as well as other students and individual substitute teachers from liability, and hold them harmless for any injury to my person, and damage to my property while on the premises at 350 Cambridge Rd. Woburn, MA 01801 or 1762 Massachusetts Ave, Lexington MA 02420 whether caused in or out of class, by negligence or otherwise. I know that yoga and barre requires alignment of the body and that yoga teachers often adjust students to help them get the poses more accurately. By signing below, I consent to such touch and alignment.
I understand that Sweat and Soul Yoga or Lexington Power Yoga, both operating as LPY Yoga, will provide an area for personal belongings to be held during class, however, I agree that Sweat and Soul Yoga, Inc and/or Lexington Power Yoga, LLC, both operating as LPY Yoga is in no way responsible for the loss or damage of my belongings while I attend class.
I understand that by signing this waiver I am signing up to receive emails and notices from LPY Yoga.
Recording of live classes at Sweat and Soul Yoga & Lexington Power Yoga dba LPY Yoga:
In order to offer our yoga and barre classes to those not yet comfortable to return to the studio in person, we will be live streaming in person classes on Zoom. The video footage may include attendees from in studio classes.
I hereby grant permission to Sweat and Soul Yoga, Inc and Lexington Power Yoga, LLC both doing business as LPY Yoga the rights of my image in video or still. I understand that my image may be published or distributed and waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive the right to any royalties or compensation arising or related to the use of my image or recording.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with attendance or teaching at Sweat and Soul Yoga, Inc. or Lexington Power Yoga, LLC both doing business as LPY Yoga or participation in yoga or barre classes. On my behalf I hereby release, covenant not to sue, discharge, and hold harmless LPY Yoga, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Sweat and Soul Yoga and/or Lexington Power Yoga, dba LPY Yoga and its employees, whether a COVID-19 infection occurs before, during, or after participation in any of LPY Yoga’s classes.
Memberships & Payments
ACCOUNT
In order to access our Services, you need to create an account, on our website or through our app (downloadable from the App Store and from the Google Play Store). If you need help or have trouble, our staff could help you set up a new account. You may modify or close your account through your settings at any time by logging in. If you close your account or request us via email that we delete your account, you may lose access to content you have purchased. No refunds will be issued.
MEMBERSHIP BENEFITS
Annual Unlimited Memberships receive 10% off retail, and 10% off Workshops, free towel rental and discounted access to our On-demand library. Members also have 12 guest passes per year, no fee for late cancel/no show, and 2 week account freeze, only allowed annually - no extensions. Monthly Unlimited AutoRenew Memberships (with a 3 month minimum commitment required) receive 10% off retail and 10% off Workshops and free towel rental. Members also have 1 guest pass per month - 3 month minimum. No fee for late cancel/no show.
ACCESS & PRICES
Memberships and Packages have access to regularly scheduled in-studio and livestream online classes (check our website for the schedule). On-demand access to our h’OM’e Studio Library requires additional payment. Events such as workshops, teacher training sessions, and special series require additional payment for access. Seniors, students, veterans, and military have special prices reserved, only after given proof of their status through a valid I.D. Not valid on former purchases.
PAYMENTS
In order to buy our Services, you need to provide us with a valid credit card, through your account or in studio. Memberships are due based on a period of time and not on actual usage of our studios. Payment for additional items and services we offer, such as events and fees for rentals (towels, yoga mat, yogi toes), shall be paid by additional credit card transaction(s). Your card information is safe, properly secured by our account service provider.
CANCELLATIONS
After the minimum monthly payment you can cancel your membership at anytime by emailing us at info@lpyyoga.com as long as it is before your renewal date.
Guests
You are more than welcome to bring guests to our studios to take classes with you. They don’t necessarily need to have an LPY account if you’re going to pay with your plan or credits. Also, based on your plan, you may have a certain number of (free) guest passes:
Annual Unlimited Memberships have 12 guest passes per year.
Monthly Unlimited AutoRenew Memberships have 1 guest pass per month.
Non-sale credit packs are shareable with friends and family. Some sale packs may be shareable. Details will be listed with the sale.
Children Participation
Children ages 13-15 are allowed to attend classes that are not heated with a parent or guardian only. At the age of 16 children can attend classes, included heated, alone. Children under the age of 13 are not allowed.
General Terms
In addition to the above listed terms and conditions, LPY may communicate additional rules, verbally or with flyers/posters posted within the studios, related to safety issues, behaviors, and mutual respect. Members are kindly invited to follow them, always being respectful in the use of the facilities.
